"Not with a bang, but a wimper?"

So, I'm wondering... are we losing the habit of democracy?

That, while sometimes the correct position, removes a lot of the responsibility for making good laws and enforcing them from the branches that are supposed to do that, and puts it on the non-democratic branch of government. Scary thoughts.

Indeed. I can also perceive that it has the effect of redirecting a lot of civic energy towards the courthouses. Moreover, it's bound to have the affect of increasing the power of those legal experts who are capable of operating within the specialized field of law. While not necessarily bad, it does suggest the creation of a quasi-aristocracy (or priesthood). Politics, for all of its warts, is accessible as a mode of activity. Law is tricky business, and the purview of expertise.
